OverviewAs part of their participation in multinational military operations, troop-contributing states are required to take detainees. But what if the State does not want to keep the detainee in its own custody? Under what conditions is it possible to transfer detainees to another State? Despite their primary applicability in armed conflicts, the international humanitarian law rules on detainee transfers have so far received little attention in comparison to the human rights law prohibition of refoulement.
