OverviewArticle 53 of law n°73-021 of 20 July 1973 as amended and completed on 18 July 1980 stipulates that the Congolese State is the exclusive, inalienable and imprescriptible owner of the soil and subsoil. In fact, it is through its private domain that the Congolese State grants its land to individuals or legal entities under private law, giving them the possibility of proving their rights of enjoyment over the said concessions thanks to the registration certificate. However, it is clear that nowadays, several individuals or legal entities under private law falsify the registration certificate. This gives rise to several conflicts throughout the city of Kinshasa. Faced with this situation, we felt obliged to reflect through this work on the legal security of land concessionaires in order to propose its strengthening.
