Overview

'The greatest happiness of the greatest number' is the principle of Jeremy Bentham. 'Nature has put man under the realm of pleasure and pain and we are indebted to them all our ideas; we look up to them all our judgements and all the fortitude of our life.'1 The concept of pleasure and pain is a belief which endures the principle of greatest happiness and contributes to the greatest number of people. All human beings are equally capable of utilizing such pleasure and pain. A society becomes complete where all the people work together and enjoy the pleasure obtained from reciprocal collaboration. The basic unit in our society is the family; it is an institution which binds all the members and is based on feelings that are responsive and contiguous, it is known as a 'natural ethical community.'2 Family institution is based on natural love and affection; the care it conveys to each other is universal and has a divine quality. The development of a family depends upon the marriage between the individuals, it brings social harmony and protection to the women as it provides marital legal rights and obligation to both the spouses. According to Hindu Law, marriage is termed as a sacred union which is performed for religious duties,3 and it binds two heterosexuals together for lifetime. According to Rig Veda, women had limited right of inheritance. In the matrimonial alliance, she was entitled to only one third right over her husband's property when he was alive, but after his death, she had no such right and was supposed to lead an ascetic life. To secure her basic right, it becomes necessary to protect her economic rights.
