Overview

This manual, supporting the landlord and tenant option in the Bar Vocationla Course, considers the statutory codes governing the three types of tenancy most frequently encountered and includes the important amendments made by the Housing Act 1996 relevant to these codes. Both the option and manual also include three other areas of great importance early in practice: the unlawful eviction of a tenant or licensee; the liability of both landlord and tenant for repair of the premises; and the evergreen lease/licence distinction. Other residential statutory codes encountered less frequently are also outlined. In addition to the necessary discussion of the substantive law, the manual contains practical guidance and checklists. These include: guides to conducting possession actions in cases involving the three main statutory residential codes; a fully worked example of an opinion and draft pleading in a Housing Act 1988 possession action; a guide to completing the inadequate County Court Form N 119; guides to conducting a tenant's claim for unlawful eviction and for breach of a landlord's repairing obligations; a guide to conducting possession proceedings against trespassers; and a guide to making applications for interlocutory injunctions and advice as to the implications of one of the parties being legally aided. The manual also contains precedents and working drafts of landlord and tenant pleadings and of some of the most important forms and notices.
