OverviewThis thesis sets forth a methodology for the practicing attorney faced with a problem concerning eyewitness identification. It discusses sixth amendment rights since it was the focus in this area that brought eyewitness identification to the forefront. It determines whether the right to counsel exists and the content of the right. The thesis also deals with the fifth amendment rights and attacks based on this amendment. Another portion covers the most overlooked area concerning eyewitness identification, fourth amendment rights. Because the Supreme Court has focused on the right to counsel and the fairness of the lineup many have not considered how or when the suspect would be brought to the police station to stand in a lineup.
