OverviewAn Exploratory Study of Legal Assistance Provided by Lawyers. The Professional Role of Attorneys and their Duty under Section 49a Paragraph 1 of the German Federal Lawyers' Act (BRAO) as an Instrument for Ensuring Equal Access to Justice in Law and Practice The study focuses on the practical implementation of the professional duties of lawyers according to 49a(1) BRAO. Despite legal requirements, there are discrepancies in practice. Statistical analyses and a conducted survey show that lawyers perceive barriers to legal aid, particularly in terms of financial and time resources. Empirical data highlight that a lack of incentives and insufficient awareness of the legal framework affect the willingness to undertake such cases. The need for structural improvements is emphasized.
