English summary: The Exceptions to Trade Secret Protection Sec. 5 of the German Trade Secrets Protection Act provides exceptions to the prohibitions in Sec. 4. The exceptions require further specification. The aim of the present study is to specify these exceptions. This applies in particular to the exceptions regarding the exercising of freedom of expression and other misconduct, as well as the exception in favor of other legitimate interests. In the latter aspect, this study especially elaborates on development potential. German description: Geschaftsgeheimnisse, die weder unter das Patent- noch das Urheberrecht fallen, sind schwer fassbar und gewinnen in der heutigen Gesellschaft zunehmend an Bedeutung. 5 GeschGehG sieht insgesamt vier Ausnahmen von den Verboten des 4 vor. Die Ausnahmen weisen allesamt Konkretisierungsbedarf auf. Diese Konkretisierung setzt sich die vorliegende Untersuchung zum Ziel. Es gilt dabei ein System zu entwickeln, das sowohl den Gerichten als auch den potenziellen Nutzern des 5 als juristische Laien mehr Sicherheit an die Hand gibt, um die mit einer rechtswidrigen Handlung einhergehenden Risiken zu minimieren. Besonders grossen Forschungsbedarf weisen hier die Teilschranke zur Ausubung der freien Meinungsausserung aus 5 Nr. 1, das sonstige Fehlverhalten aus 5 Nr. 2 als auch die Ausnahme zu Gunsten sonstiger legitimer Interessen auf, deren Schutzumfang und Entwicklungspotential die Untersuchung herausarbeitet.

Author Information

Emma Kleinvogel studied law at the Humboldt University of Berlin. Following her first state examination in law, she worked in the patent law department of a leading law firm and simultaneously began her doctorate at the Ludwig Maximilian University of Munich under the supervision of Prof. Dr. Ohly, LL.M. (Cambridge). In February 2022, she was accepted into the doctoral scholarship of the German National Academic Foundation and has since been working part-time as a research assistant at the chair of Prof. Dr. Bachmann, LL.M. (Michigan) at Humboldt University of Berlin. Since May 2023 she has been a trainee lawyer at the Berlin Higher Regional Court.
