The author compares the relevant provisions in both countries and concludes that pretrial detention to prevent an uproar in the population can be justified in Serbia but not in Germany. The difference she perceives is due to the difference between historical and cultural conditions in both countries. Dies gilt auch dann, wenn weder zu erwarten ist, dass er sich dem Verfahren durch Flucht entzieht, noch dass er Beweismittel beeintrachtigt. In beiden Landern werden diese Regelungen kritisiert, unter anderem wegen Verletzung der Unschuldsvermutung. Die Verfasserin vergleicht die entsprechenden Vorschriften in Serbien und Deutschland im Hinblick auf ihre historische Entwicklung, ihre Ausgestaltung und Funktion sowie ihre Anwendung in der Praxis. Im Mittelpunkt steht dabei die Frage nach der Legitimation der Regelungen. Die Autorin gelangt zu dem Ergebnis, dass die Existenz eines Haftgrundes der Tatschwere nur in Serbien uberzeugend begrundet werden kann. Dies beruht vor allem auf den erheblichen historischen und kulturellen Unterschieden zwischen beiden Landern.
