OverviewCriminal responsibility is defined as the obligation to undergo the punishment provided for by law in reparation for an offence committed; or the obligation to answer for one's criminal acts and to undergo the punishment attached to them by law. This subject, which arouses a great deal of passion, may be seen by some as anathema to the art of Hippocrates, or as an indictment of healthcare professionals as a whole. This extrapolation can only be the result of hasty and erroneous conclusions, since the scientific purpose of this study is to present to the public the legal framework of the criminal liability of health workers in the Republic of Congo. In fact, this work provides an analysis of the laws and regulations governing the exercise of the health professions, the system of individual criminal liability, and the state of Congolese case law in this area. The aim is to strengthen the repression of offences committed by health professionals through the adoption and implementation of appropriate criminal and penal policies for better social defence.
