OverviewThe book ""Congolese media regulation law"" briefly traces the history of the press in the Democratic Republic of Congo, from government monopoly to liberalization of the sector. It focuses on the control of the media by an authority independent of the government, the regulatory procedure and the competence of this authority vis-à-vis the media and professionals.A number of procedural weaknesses are highlighted, justified by a refusal to comply with current legislation and a clear desire to punish professional journalists instead of the media.The book shows that, under this legislation, a media professional can only be brought before the courts on the basis of a prior complaint from the regulatory authority. This is due, among other things, to the fact that the regulatory authority is empowered to take legal action against media professionals who violate criminal law in the exercise of their profession, and that, according to this legislation, it is the only authority competent to regulate media content.Self-regulation and co-regulation are addressed, as are many other issues.
