Overview

"This new legal practice course marks a shift in focus, from the traditional book learning of the old course towards an emphasis on legal skills gained through practical exercises. This book on civil litigation is part of a series which provides a guide to the law, practice and procedure. Each guide explains the relevant substantive and procedural law and where appropriate contains sample precedents, documents and check lists, as well as excerpts from relevant practitioner texts. Sample questions and exercises are also included as a stimulus to further reading. The guides form a bridge between the notes and workbooks produced by each teaching institution and the raw material found in the practitioner texts. This comprehensive, self-contained resource book describes, with illustrations and precedents, the whole of the civil litigation process from first obtaining instructions through to trial and enforcement of judgments. This updated edition covers all recent changes in legislation, including the Civil Evidence Act 1995. It also includes a table of cases and a table of statutues. The author gives particular emphasis to personal injury litigation and actions in contract. In addition to a description of the relevant procedures, all relevant tactical and practical matters are also dealt with, together with consideration of the skills aspects, including: managing a civil litigation case load and time costing; interviewing the client and witnesses; negotiations; research and drafting; and fact management and advocacy. Particular emphasis is given to the rules of civil evidence and their practical application. It is intended that the guide should be free-standing, so that reference to other texts, with the exception of the ""Supreme Court Practice"" and the ""County Court Practice"" is unlikely to be required. Craig Osborne is the author of ""Manual of High Court Litigation""."
