English summary: Toward Rational and Consistent Sentencing. Empirical, Comparative, and Reform-Oriented Studies Sentencing is a central issue of current debates on criminal justice reform. This volume presents the results of empirical studies on sentencing, including evaluations of the reasons given by judges for sentences imposed in cases of rape and residential burglary, an analysis of appellate court decisions on matters of sentencing, and findings from an empirical study on lay persons' and judges' notions of just sentencing. Chapters on sentencing in England and Wales and on reform options complement the empirical enquiries. German description: Theorie und Praxis der Strafzumessung rucken verstarkt in den Fokus der Reformpolitik. Der Band enthalt wichtige Beitrage zum Stand der empirischen und rechtsvergleichenden Forschung auf diesem Gebiet. Im Mittelpunkt stehen Berichte uber empirische Untersuchungen, die im Rahmen eines von der DFG geforderten Forschungsprojekts Gerechte Strafzumessung durchgefuhrt worden sind. Im Rahmen dieses Projekts wurde eine Vielzahl von Urteilen zu Wohnungseinbruchdiebstahlen und sexuellen Ubergriffen sowie Entscheidungen von Revisionsgerichten mit Blick auf die Strafzumessung ausgewertet. Ausserdem enthalt der Band die Ergebnisse einer empirischen Studie uber unterschiedliche Vorstellungen von Berufsrichtern und Laien bezuglich angemessener Strafen. Dies alles wird aus der Perspektive der Strafrechtspraxis, der Rechtsvergleichung und aktueller Reformuberlegungen in Deutschland diskutiert.

Elisa Hoven is a professor for German and International Criminal Law and criminal procedure law at the University of Leipzig and a judge at the Constitutional Court of Saxony. She studied law at the Free University of Berlin, the Radboud Universitaet Nijmegen and the University of Cambridge. She wrote her PhD on international criminal proceedings and worked as Visiting Professional at the ICC in The Hague and the Extraordinary Chambers in the Courts of Cambodia. Elisa was a Visiting Scholar at the Berkeley University, Harvard University, Basel University, University of California, Los Angeles, and the University of Sydney. Thomas Weigend received his doctoral degree in law and his Habilitation at the University of Freiburg. He taught criminal law and criminal procedure at the University of Cologne Faculty of Law from 1986 to 2016. He has published seven books and many articles in German and foreign journals. His main research interests are in criminal law theory, (comparative) criminal procedure, criminal policy, and international criminal law. He has taught as a visiting professor at the University of Bologna, the University of Leuven, New York University, Tokyo University, Peking University, China University of Political Science and Law, and several others.
