English summary: What can the Representative Action Learn from the KapMuG Capital Investor Model Proceedings Act (KapMuG)? Assessment of Central Provisions of the New Representative Action (VDuG) in Comparison to the KapMuG Taking into account the new representative action (Verbandsklage) that only came into force in October 2023 and the ongoing reform of the Capital Investor Model Proceedings Act (KapMuG) in 2024, the present work could not be more current, especially as it also addresses other models for mass actions. The work combines extensive experience from twenty years of practical work in collective redress with the latest research to sometimes surprising results and provides valuable interpretation aids for practice and impulses for the further development of so-called class actions. German description: Im Oktober 2023 trat die Verbandsklage in Kraft und derzeit wird der Referentenentwurf zur KapMuG-Reform in 2024 diskutiert. Aktueller konnte also die vorliegende Arbeit nicht sein, zumal sie auch andere Modelle fur Massenklagen wie das vorgeschlagene Leitentscheidungs- und das Vorabentscheidungsverfahren thematisiert. Insbesondere verbindet sie tiefgehende und teilweise uberraschende Erfahrungen aus zwanzig Jahren praktischer Tatigkeit mit dem KapMuG und anderen Massenverfahren mit einer vertieften wissenschaftlichen Untersuchung der neuen Verbandsklage. Auf dieser Basis liefert die Arbeit sowohl wertvolle Auslegungshilfen fur die Praxis hinsichtlich der bisherigen und der neuen Regelungen und zugleich profund erarbeitete Vorschlage fur die Fortentwicklung des kollektiven Rechtsschutzes. Beispielhaft seien insofern die Ergebnisse zum Anwendungsbereich des KapMuG, zur Klageberechtigung, zur Nutzung der Schwarmintelligenz, zu den Problemen der Anmeldung und zur umfassenden Aussetzung von Parallelverfahren zur Entlastung der Gerichte genannt.
