The Relationship between Individual and Collective Enforcement for Misleading Advertising towards Consumers Misleading commercial practices can be combated under unfair competition law, but how can consumers defend themselves against unfair practices? This thesis presents a dogmatic analysis of the relationship between unfair competition law and civil law remedies and examines whether individual remedies under the German Civil Code and the collective legal protection under the Unfair Competition Act are independent regimes or interconnected mechanisms, especially in view of 9 para. 2 UWG. Die Arbeit stellt eine dogmatische Studie des Verhaltnisses des Lauterkeitsrechts zu den burgerrechtlichen Rechtsbehelfen dar und untersucht, ob es sich bei dem Individualrechtsschutz nach BGB und dem Kollektivrechtsschutz des UWG um unabhangige Schutzregime oder ineinandergreifende Zahnrader handelt. Der Autor fokussiert sich auf tauschungsbedingte Zivilrechtsbehelfe gegenuber der Irrefuhrung. Hierdurch werden einschlagige Fallgruppen aus zivil- und lauterkeitsrechtlicher Perspektive gegenuberstellend analysiert. Der Autor zeigt auf, dass Vertragsrecht und Lauterkeitsrecht unterschiedlich wirken. Dennoch finden sich bei den zivilrechtlichen Individualrechtsbehelfen Einfallstore fur lauterkeitsrechtliche Wertungen. Letztlich mussen burgerrechtliche Rechtsbehelfe und lauterkeitsrechtliche Verbotsnormen zusammengedacht werden. He then began his legal traineeship (Referendariat) at the Bamberg Higher Regional Court (Bayreuth Regional Court) in 2019 and passed the second state exam in 2021.
