English summary: Protection and Limitations of Copyright for Scientific Publications. An Economic Analysis of Law German copyright protects the works of scientific authors and the investments of scientific publishers. However, as a prohibitive right, it also inhibits access to new knowledge which is a prerequisite for the creation of further scientific publications. In view of the rising prices of scientific publications as well as the emergence of modern technologies and publication options (e.g. open access), the question arises: How much copyright protection does academic science need? German description: Das Urheberrecht schutzt die Werke wissenschaftlicher Autoren und die Investitionen wissenschaftlicher Verlage. Als Verbotsrecht hemmt es aber zugleich den Zugang zu neuem Wissen, das Voraussetzung fur die Schopfung weiterer wissenschaftlicher Publikationen ist. Angesichts steigender Preise wissenschaftlicher Publikationen sowie dem Aufkommen moderner Technologien und Publikationsmoglichkeiten stellt sich zunehmend die Frage: Wie viel urheberrechtlichen Schutz braucht die Wissenschaft? Aufbauend auf rechtsokonomischen und soziologischen Erkenntnissen zeigt die Untersuchung, welche negativen Auswirkungen ein zu hohes Schutzniveau auf das wissenschaftliche Kommunikationssystem und damit den Fortschritt der Wissenschaft hat. Die geltenden Schranken des Wissenschaftsurheberrechts ( 60a ff. UrhG) greifen bislang zu kurz, um bestehende Informationszugangsprobleme zu losen. Die Arbeit entwickelt daher eigene Reformvorschlage, durch die zukunftig wissenschaftsschadliche Preisstrukturen auf dem Publikationsmarkt verhindert werden konnten.
