OverviewThe main objective of this paper is to identify the conceptual and legal aspects of outsourcing, as well as to describe the guiding principles of labour law, which guarantee the rights of outsourced workers. It also aims to identify the main weaknesses in the legislation pertaining to outsourcing. Outsourcing is a practice that has been widely used in companies. A brief history of outsourcing was then given, among other related subjects. It also discusses Bill 4.330/2004, which is necessary to regulate outsourcing. This topic was chosen because of the author's experience in an extra-curricular internship in the labour area, actively participating in hearings in the labour courts of the states of Paraíba, Pernambuco and Rio Grande do Norte, concerning the actions of outsourced workers in banks, who performed the company's core business. Illegal outsourcing is becoming increasingly common in the Brazilian economic market and despite various discussions between workers, trade union centres, unions and government officials, a solution has yet to be found.
