In response, a collective action aimed at achieving a binding determination of common facts, along with an EU representative collective action were amended. Consequently, it is anticipated that there will be an increase in collective settlements. This dissertation aims to outline the risks associated with settlements in mass proceedings and explore potential solutions by comparing the legal frameworks in the USA and the Netherlands. German description: Der Vergleich wird oft als zentrales Mittel zur schnellen und kostengunstigen Beilegung von Rechtsstreitigkeiten angesehen und daher insbesondere auch vom Gesetzgeber gefordert. In jungerer Zeit pragten Massenschadensfalle die rechtspolitische Diskussion in Deutschland. Der Gesetzgeber reagierte mit Einfuhrung der Musterfeststellungsklage und der EU-Verbandsklage. Es steht zu erwarten, dass es auch in Deutschland in Zukunft vermehrt zu Kollektivvergleichen kommen wird - eine Praxis, die in den USA bereits seit Langem gangig ist. Die Arbeit unternimmt es, rechtsvergleichend zu den USA und den Niederlanden die Gefahren von Vergleichen in Massenverfahren und mogliche Losungswege aufzuzeigen. Missbrauchsgefahren resultieren nach der Principal-Agent-Theorie insbesondere aus Interessengegensatzen zwischen den Geschadigten und deren Reprasentanten wie einem Verbraucherverband oder einer weitgehend autonom agierenden Anwaltschaft.
