OverviewThis text discusses a range of industrial relations and common law jurisdictions, to study employment disputes in the European Union civil service and their resolution in accordance with the Treaties and Staff Regulations by the European Court. The vast reported case law is discussed, extracting the essential nature and principles of law developed by the Court of Justice and, after 1989, by the Court of First Instance. In the course of the study, the author seeks to identify the nature of the European civil service and the nature of the public law principles developed by the Courts, as well as the difficulties inherent in the resolution of employment disputes by a strict judicial process. Consideration is given to the appellate jurisdiction and practice of the Court of Justice and there is reference to the relevant European literature.
