OverviewThe purpose of this essay is to present injunctive relief and discuss its impact on the Information Society, with regard to the protection of privacy on the Internet, in light of the fundamental right to effective jurisdiction. If, on the one hand, the rise of the information age has contributed to the general development of civilisation, providing the growth of knowledge, based on easy and quick access to information, on the other hand, the more the use of information technology facilitates the interconnection of people, the more it enables the formation of large databases that invade the lives of individuals, without their authorisation or even without their knowledge. The changes brought about by the Information Society make it necessary for the law to regulate the new situations that have arisen. To this end, it is essential for the judge to be aware of this reality in order to apply the procedural technique best suited to the needs of the substantive law, as a result of the fundamental right to effective jurisdiction, in order to offer judicial protection aimed at inhibiting the violation of the right to privacy on the Internet, guaranteeing citizens' fundamental rights.
