OverviewEnglish summary: The Acknowledgement in Private Insurance Law. A Study on Settlement Declarations of the Insurer The thesis deals with the insurer's declarations to pay insurance benefits. In addition to the acknowledgements specifically regulated in occupational disability and accident insurance ( 173, 187 VVG), the meaning of the insurer's declarations in other types of insurance is examined. On this basis, approaches to the legal nature of the acknowledgements regulated in the VVG are formulated and guidelines for the interpretation of typical settlement declarations in other types of insurance are developed. German description: Der Bedeutungsgehalt von regulierungsbezogenen Erklarungen des Versicherers bereitet in der Praxis haufig Probleme und fuhrt zu Streit, wenn der Versicherer die tatsachlichen oder rechtlichen Voraussetzungen seiner Eintrittspflicht nachtraglich verneint und Leistungen deshalb verweigert. Vor diesem Hintergrund beschaftigt sich die Arbeit mit der Frage, wie und mit welchen Folgen fur die Vertragsparteien Regulierungserklarungen des Versicherers rechtlich einzuordnen sind. Im Fokus stehen dabei nicht nur die verschiedenen Auspragungen des zivilrechtlichen Anerkenntnisses, sondern auch die in der Berufsunfahigkeits- und Unfallversicherung speziell normierten Anerkenntnisse der 173, 187 VVG. Durch eine sorgfaltige und kritische Auswertung der bisher erfolgten Judikatur gelingt es, Losungsansatze zur Rechtsnatur der im VVG geregelten Anerkenntnisse zu formulieren und Leitlinien zur Auslegung typischer Regulierungserklarungen in sonstigen Versicherungsarten zu entwickeln.
